The Osun State Ministry of Justice, on Tuesday, took over the case filed against a 38-year-old man, Oluwatomisin Olabiyi, who was earlier arraigned by the Department of State Services before a Magistrate’s Court in Osogbo for allegedly defiling a five-year-old girl.

The DSS had in March, this year, arraigned Olabiyi before Magistrate Oyin Daramola, on two counts of forcefully defiling a child and indecent assault of a child.

The secret police alleged that the crime was committed in November, 2022, behind Matrix filling station, Owode, Ede, Osun State.

Olabiyi was said to have sexually molested the girl, who is a daughter to his co-tenant.

When the matter came up on Tuesday, Assistant Chief State counsel, Motolani Shokefun, informed the court that the Ministry of Justice planned to amend the charges because it is defective.

She sought an adjournment for the fresh charges to be filed at the high court after it has been withdrawn from the magistrate court.

The defence counsel, Ayo Ajibola, did not object to the request.

Magistrate Daramola thereafter adjourned the case till September 26, 2023 for mention.
