An ex-convict, Saheed Babatunde has been sentenced to five years imprisonment without option of fine for stealing a motorcycle.
Babatunde, 20, who was jailed by a Magistrate court sitting in Osogbo, Osun State was said to have recently completed a two-year jail term at the IlesaMaximum Prison for stealing.
He committed the fresh crime on March 28, 2016.
Police prosecutor, Taiwo Adegoke, informed the court after Babatunde pleaded guilty to the one-count charge of theft against him, that the ex-convict had been unrepentant.
Adegoke, an Inspector of Police, said the accused had at about 4:00pm, between Osogbo/Iree Road waylaid one Kamorudeen Ademola, a commercial motorcyclist and dispossessed him of the motorcycle.
The charge sheet obtained from the court reads, “That you, Saheed Babatunde, on the 28th March, 2016 at about 4:00pm between Osogbo and Iree in OsogboMagisterial District, did steal one Bajaj motorcycle valued at N137,000, property of one Kamorudeen Ademola.”
The prosecution argued that the accused had contravened Section 390 (9) of the Criminal Code, Cap 34, Vol. II, laws of Osun state of Nigeria, 2003.
Babatunde’s counsel, Dada Olawale, prayed the court to temper justice with mercy in sentencing the convict.
But the presiding Magistrate, Olusola Aluko sentenced the ex-convict to five years imprisonment without any option of fine.
