The Court of Appeal, sitting in Abuja on Monday reinstated Sheriff Oborevwori as the 2023 governorship candidate of the Peoples Democratic Party in Delta State.
The appellate court in its judgement set aside the judgement of the lower court on many grounds, particularly on the ground of lack of jurisdiction.
David Edevbie sometime ago filed a case at Federal High Court, Abuja, against the emergence Oborevwori. In the said suit, Edevbie challenged the educational qualifications of Oborevwori.
The lower Court entered judgement in favour of Edevbie.
However, Oborevwori and PDP, dissatisfied with the said judgement, appealed against same.
The appellate court in its judgement held as follows: Allegations of fraud/presentation of fake documents cannnot be resolved by originating
summons. Case of forgery cannot be decided by affidavit evidence. That the suit ought to have been commenced by writ of summons, and not originating summons. That since the case was predicated on presentation of forged documents, calling of witnesses was a condition sine quanon for determining same. That the cause of action was not yet ripe before Edevbie went to Court, and same robbed the Court of jurisdiction.
