Court restrains INEC over Melaye’s recall

A Federal High court sitting in Abuja, on Monday, halted the on-going process by the Independent National Electoral Commission to recall a senator representing Kogi West senatorial district, Senator Dino Melaye.

INEC began the process of Melaye’s recall recently with verification of names and signatures allegedly submitted by voters from his senatorial district who wanted him recalled.

In his pronouncement on the case, with suit no: FHC/ABJ/CR/567/2017, presiding judge, John Tsoho, restrained the electoral body from further continuing with the process of acting on the purported petition presented to it by the senator’s constituency.

The judge granted “an order of interim injunction, restraining the defendant (INEC), whether by itself, staff, employee or agents, from commencing or further continuing with the petition presented to it by the plaintiff’s (Melaye) constituents, pending the hearing and determination of the motion on Notice.”

The case was, however, adjourned to September 29, 2017, for hearing of the plaintiff and motion on notice and application for joinder.
